Relatives unsure of killer's claim in Texas deaths

(AP) ? At age 84, Elmer Pitchford knows time is running out for him to learn who killed his teenage daughter four decades ago in Houston.

"I would like to know before I die, that's for sure," he said.

But the retired dock worker said he's not sure what to think of claims being made by Edward Harold Bell, a 72-year-old Texas prison inmate who claims he killed nearly a dozen young girls found murdered in southeast Texas in the 1970s ? including Pitchford's 16-year-old daughter, Kimberly.

Part of him wants to believe that Bell had something to do with the unsolved murder, but he also thinks Bell may turn out to be a "kook." The aunt of another slain girl also expressed mixed emotions, saying it makes her question whether the suspect convicted in her niece's death was the right man.

Investigators said that while the Bell's claims aren't entirely new and were previously investigated, they are looking at them again after he told the Houston Chronicle he was responsible for the deaths of as many as 11 girls.

"The bottom line is Ed Bell has said these things (before). Is it fodder? I don't know. I've never been able to prove anything he has said," said Capt. Chris Kincheloe of the Brazoria County Sheriff's Office, which has four of the unsolved murders for which Bell is claiming or hinting responsibility, including Kimberly Pitchford.

Bell is serving a 70-year prison sentence for the 1978 killing of a Houston-area Marine who tried to stop him from masturbating in front of a group of girls. But in recent interviews with the newspaper, he described a string of cases from 1971 to 1976.

Bell claimed he killed four girls whose names he knew, all of them teenagers, including Kimberly Pitchford. He also described four other victims he said were killed in pairs, and gave incomplete information on three others. The cases involved girls who were between the ages of 12 and 19 and were taken from towns and rural roads in Brazoria, Harris and Galveston counties.

Investigators in those counties, prompted by Bell's claims to the newspaper, have said they are reviewing evidence in the mostly unsolved murders. Bell said he would provide proof to back up his claims ? but only if he's given immunity.

Capt. Jeff Heyse, spokesman for the Galveston Police Department, which is reviewing two of the unsolved murders, said he found it "interesting" that Bell wants immunity when he is already serving a life sentence.

"We're looking at where we can go from here," Heyse said.

The newspaper reported that prosecutors in Galveston and Harris County received letters of confession from Bell in 1998, but he never was indicted because detectives were unable to verify his claims or because of cost considerations related to cold-case investigations. Harris County prosecutors apparently lost copies of Bell's letters.

Prosecutors in Galveston did not return a telephone call seeking comment from The Associated Press, while the Harris County District Attorney's Office declined comment.

Kincheloe said he read the letter that Bell sent to Galveston prosecutors and found "there was nothing there that we could use in our cases." He said Brazoria County sent two investigators in 2008 to speak with Bell about two slain girls, but Bell wouldn't talk.

Kincheloe said he wonders if Bell "running a Lucas scam," in reference to serial killer Henry Lee Lucas, who told police he killed as many as 600 people but later recanted. Lucas died in a Texas prison in March 2001, after his death sentence was commuted.

"Several aspects of Ed Bell's story have been investigated in the last 10 years and I never found anything," Kincheloe said. "It's not like people have turned a blind eye and a deaf ear to Ed Bell. We just can't find anything."

But the convicted killer's claims did shock Dotti Walker, the aunt of 14-year-old Sharon Shaw, one of the young girls that Bell didn't name but could be tied to.

Walker, 77, said she was surprised because another man was convicted for her niece's murder, as well as the slaying of Shaw's friend, 14-year-old Rhonda Renee Johnson. The two girls were abducted in 1971 after going to the beach in Galveston.

Michael Self, a mechanic from suburban Houston, was convicted of the two girls' murders and died in prison in 2000. His attorneys said during appeals that Self was wrongly accused, and the Houston Chronicle reported earlier this summer that at least two investigators, a Galveston police officer and a former Harris County prosecutor, believed that Self might have been the wrong man.

Echoing Elmer Pitchford's sentiments, Walker said she hoped investigators would go back and talk to Bell but wasn't sure whether he should be given immunity.

Before Bell's claims resurfaced this week, she had no doubt that Self was responsible for her niece's death. Now she's unsure.

"The things this man is saying seem like they are true but I don't know ... This is unsettling. It's a case of mixed emotions. Is this guy telling the truth or is he a nut job or what?"

Amazon expected to launch tablet Wednesday (AP)

NEW YORK ? Amazon is expected to unveil a tablet computer Wednesday, picking a fight with Apple Inc. and its iPad. The iPad has many challengers, but analysts say Amazon's could be different ? it has a chance to be more than a wannabe.

Amazon.com Inc. is nearly unique in its ability to sell content such as e-books, movies and music suited for a tablet, just like Apple does. In addition, the "Kindle" tablet could be a reminder, right in the owner's hands, to buy general merchandise from Amazon. Running out of toilet paper? Just add it to your Amazon shopping cart.

"In essence, the Kindle is a Trojan horse for Amazon's retail and media brands," said Morgan Keegan analyst Justin Patterson.

Seattle-based Amazon hasn't confirmed that it's launching a tablet, but it's holding an event in New York on Wednesday morning, with its CEO Jeff Bezos speaking.

With the iPad, Apple has created a whole new product category of tablet computers. Many have tried to copy its success, but so far, the iPad is the only really successful product. Apple sold 28.7 million of them from April 2010 to June 2011. Analysts at research firm Gartner Inc. expect the iPad to account for three out of four tablet sales this year.

Analysts believe Amazon's new tablet will come in two sizes: one with a screen that's 7 inches on the diagonal, a bit larger than the Kindle e-reader, and one that's 10 inches, slightly bigger than the iPad.

They also expect Amazon to subsidize the cost of the tablet, on the expectation that it will make the money back when owners buy things through the tablet. That might allow the company to undercut Apple on price, something other manufacturers have had a hard time doing. Apple's profit margin on the iPad, which starts at $499, is lower than it is for many of its other products, particularly the iPhone.

"Amazon's willingness to sell hardware at a loss, combined with the strength of its brand, content, cloud infrastructure, and commerce assets, makes it the only credible iPad competitor in the market," wrote Forrester analyst Sarah Rotman Epps.

Epps believes Amazon can sell 3 million to 5 million tablets in the fourth quarter. That compares with Apple selling 9.3 million iPads in the April to June period.

Two other companies are treading the same path as Amazon, but they don't have quite Amazon's heft. One is Barnes & Noble Inc., which launched a "Nook Color" e-reader last year that's nearly indistinguishable from a small tablet. It has a color screen, runs a version of Google Inc.'s Android operating system and accepts third-party apps. It's also modestly priced at $250. Yet Barnes & Noble sees it first and foremost as an e-reader, not as a springboard into competition with a full-blown tablet like the iPad.

Sony Corp.'s first iPad-style tablet, which started shipping two weeks ago, is linked to the company's online movie and music stores. It's set up to capitalize on Sony's library of PlayStation games as well, but so far, only plays a few of them. However, Sony doesn't come close to matching the breadth of content in Apple's iTunes store.

This year, Amazon started streaming movies for no extra charge to customers who've signed up for its Prime premium shipping program. On Monday, it added TV shows and movies from News Corp.'s 20th Century Fox studio, bringing the total number of streaming titles to 11,000 titles. That's about half of what Netflix's streaming library has.

Analysts also see Amazon as a possible bidder for Hulu, the TV-streaming website.

The question is: What unique features can Amazon bundle into its tablet that might compel consumers to choose it over an iPad? There's not that much an Amazon tablet could do that the iPad can't. The iPad can be used to read books from Amazon and Barnes & Noble, even if Apple's restrictions now make it harder to buy books directly from these stores. It can be used for general shopping from Amazon. The iPad plays movies and TV shows from Netflix and Hulu, and has access to tens of thousands of applications and games in the App Store.

On the application side, the Amazon tablet will start out at a big disadvantage, just like all the other iPad competitors. It might be able to run tablet apps from Google's marketplace, but both the selection and quality is lower than in Apple's store.

I'm about to order a Sony vaio laptop s series with i5 processor, 6 gb ram, & 500 gb harddrive but the graphics card is amd radeon 6470m 512mb vram is this good enough 4 games like WOW,final fantasy, rift. I'm a girl and I dnt know much about graphic cards.
I have 2 stick w/ Sony cause they're the only ones that provide completely pink laptops I dnt want any other color on it.except the keyboard of course.
I would like to run these games on a high medium maybe even on high settings , so is this good enough

yeah this is good enough for gaming at mid settings, do not expect highest settieng gaming from any laptop, even those crappy alienware? It will be nice, go get it. I saw some comple pink colour laptops from acer too, if you can find that with these specs, it will be better choice to take an acer coz they are tougher than vaio.

After Mitt Romney and RIck Perry, the polls indicate that few of the other GOP 2012 presidential candidates are drawing much support. DCDecoder looks at what motivates Ron Paul, Herman Cain, Buddy Roemer, and the rest to run.

(AP) ? Endurance swimmer Diana Nyad pressed on Saturday despite painful stings from a Portuguese Man o' War and a visit from a curious shark, completing nearly half her journey from Cuba to Florida.

More than 24 hours after setting off from a Havana marina, Nyad was 49 miles (79 kilometers) from the Cuban coast and stroking through favorably calm waters, her team said. She is hoping to swim 103 miles (166 kms) to Florida, besting her own record for an open-water crossing without a shark cage by about a half-mile (1 km).

Nyad's assistants, who are updating fans and well-wishers around the world via social media, downplayed the afternoon encounter with the finned predator.

"Around 1pm ? and don't everybody get excited here ? an Oceanic white tipped shark was spotted near Diana in the midst of the three boat flotilla. ... Rob MacDonald, one of (her safety) divers, swam towards the shark, where they faced off within 10 feet of one another," read a post on Nyad's website.

"I guess he thought I was more aggressive than him, and he turned in the other direction," MacDonald was quoted as saying.

Barracudas were also spotted in her general vicinity.

Without a cage to protect her, Nyad is relying on equipment surrounding her with an electrical field that is harmless but deters most sharks. Her divers are there to gently discourage any who make it through.

Nyad's nighttime run-in with the Portuguese Man o' War, described as "scary," left her with stings on her face, arms and side.

Complaining of difficulty breathing, she received oxygen and a steroid shot from her doctors and tread water while she recovered.

When she resumed swimming her handlers noted that her stroke count had dropped to 48 per minute, down from 52-55, but as the day went on she picked up the pace.

"This afternoon ? it is stunning to actually witness ? Diana is swimming stronger and stronger," her website read. "Her strokes are up to 50 per minute, she is eating pasta, gobbling bananas, bits of peanut butter sandwiches, along with high-carb & high calorie liquid concoctions."

Her website reported that she seemed to revive significantly after consuming blended chicken soup.

The Los Angeles woman pauses every 45 and 90 minutes to rest and refuel on food that her assistants pass to her in the water, but without getting on the boat.

As the sun set, a different kind of encounter with marine life was more pleasant.

"At 7:10pm, on the crimson horizon of the Straits of Florida, ten pilot whales emerged in the distance just ahead of Diana," said a tweet.

Her team said a critical phase of the swim was beginning, as an observer on the boat said marathon swimmers are more likely to succeed if they make it through the second night.

Nyad says her strategy for enduring the roughly 60 hours it should take her to swim from Cuba to Florida, testing the limits of human exhaustion at the age of 62, is to focus on one partial goal after another.

"The mental approach has to be to parcel it out. No one could swim the whole thing while thinking about the whole thing," she said on her website. "Till I get a glimpse of the final shore I can't start obsessing on it ? it's too far away, too nebulous ? I don't know where it is. So I'm going to take it night by day: first get through the nighttime and then get through the daytime, and then the nighttime again, and so on."

She told reporters Friday in Havana that she likes to sing songs inside her head to pass the hours. Among her favorites: The Beatles, Janis Joplin and Bob Dylan.

Nyad is making her second attempt in as many months at the Cuba-Florida crossing, a lifelong dream that she first tried as a 28-year-old back in 1978, when she swam inside a steel shark cage for about 42 hours before ending the attempt.

A cageless attempt this August fell short 29 hours in when, gasping for breath, Nyad threw in the towel after an 11-hour asthma attack she blamed on a bad reaction to a new medicine.

But she said the experience did not convince her that she was physically not up to the challenge, and Nyad, who insisted the problems had nothing to do with her age, came to think of the aborted swim not as a failure but an unplanned dress rehearsal.

Though she had vowed there would be no second attempt, this week she flew to Cuba to take advantage of what she called a "magical window" of good weather and sea conditions.

Nyad, who expects to lose about 15 pounds (6.8 kilograms) on the crossing, hopes to make landfall in Florida around Monday morning.

She added that the greatest goal of the Writing Center is to help students through the writing and speaking process, providing special help for international students.
Castner-Post has been the director of the Writing Center since 2007.
?We have seen students from just about every discipline from across the campus from chemistry to biology, music appreciation, composition and literature courses,? Castner-Post said. ?People will be surprised about how much writing goes on around campus.?
Senior Robert Downing said that the students he tutors always help him in a way.
?Eventually, I want to be a teacher. Every chance that you get to teach something, you learn ?that? a little bit better,? Downing said. ?Also, you learn more about yourself, because you figure out, ?Why did I actually suggest this?? or ?Why did I ask the question and what does that mean?? If you get the chance to think about it, you start realizing a lot about what makes you a good student, teacher and who you are as a person.?
Downing specializes in expository essays and he has been working with the Writing Center since 2009. He also said that the Writing Center has been beneficial to him before he started working there.
?I?ve come here a couple of times for a research project for a literature class,? Downing said. ?In high school and starting in college, I didn?t know what revising was. I was one of those students that did the one draft style of writing. I wrote it, got it done, submitted it and got my grade. ?
The Writing Center offers face-to-face tutoring so students can talk about writing and the process, from the brainstorming phases to the to the sentence level issue.
?When a student comes in, we talk about how the Writing Center works and that is from global to local,? Castner-Post said. ?So we?ll start with the bigger things first because a project doesn?t have a clear focus. We start with the big issues first like the focus, the organization, the development, the research, the documentation and then finally the sentence level.
She said they try to hire tutors from across the discipline. They have chemistry majors, history majors and commonly, English and writing majors.
The Writing Center also has an email tutoring service. In case a student cannot make it to the Writing Center, they can submit their work to the tutors via email. They usually respond within 24 hours. Tutoring through Skype is available as well. A student can be tutored from home and at the same time see the tutor?s face.
Writing Center bookmarks can be found all over campus for a step-by-step process on how to schedule an appointment, along with the available hours.
Students can also be assisted with speeches in the Writing Center. The speeches are recorded visually and auditory. The tape is emailed to them so that they can watch and listen to themselves. The staff also helps with the speeches? text of the speech to offer extra assistance with context and style before they start working on delivery.
?We had a budget cut in 2009 along with every other service at the university and we recently got our funding back and so our student utilization has grown already,? Downing said.
The Writing Center?s fee is now $2.50 per credit hour.
?We all really appreciate the funding increase,? Downing said. ?We hope that students will take advantage of the opportunity to come to the writing center, because we got the money to help students. Writing is one of the hardest things to do going out of high school into college, especially if you?re doing it alone.?
There are many tip sheets online to assist with documentation and different genres. Students can pull off examples from the Writing Center?s website.
The Writing Center tutors try to help improve students? writing and encourage students to come back. Castner-Post compared writing to sports in the fact that the more you practice, the better you will get. They are in the process of buying a software package for those students featuring grammatical and instructional components of the test so they can hone their skills to the sentence level.
?We keep growing in the number of students who are using the Writing Center, so that?s exciting to us,? Castner-Post said.
The Writing Center has a YouTube channel with entertainment videos on different writing issues like how to use the Writing Center, what it does to help students with their writing and credible vs. non-credible sources.
The Writing Center also has a Facebook page and a Twitter account, all titled ?UCA Writing Center,? along with its YouTube channel. The Facebook page has many of the same features, plus daily sentence-level and global writing help.
?One of the fun things we do is on our YouTube channel,? Downing said. ?We do videos that are kind of funny, tackling ideas about writing in a funny way because we a put through a long time of work and we realize the teacher lectures and sometimes even the sit-down sessions isn?t enough to really help energize people to think about their own writing process.?
The tutors are certified by the International College Reading and Learning Association. To get certified, they are first recognized by a UCA professor as an excellent writer and empathetic person. The group of people goes through interviews. The students who have sparked interest are required to submit a writing portfolio.
After examinations, the students of interest are invited to register for a three-hour, four-credit course titled ?Teaching and Tutoring Writing.?
In this course, students learn the theory and practice of teaching writing. They also work in the Writing Center under tutors, shadowing them for a semester within the class. The students who excel are hired in the Writing Center.
?All writers benefit from a fresh pair of eyes because writing is a social process,? Castner-Post said. ?It?s not something we do effectively alone, writers at all levels. When working on a writing project, everything is typically figured out. It?s a challenge to get what?s in your head on the page. The more you practice and feedback you get, the more you improve.?
The Writing Center is typically busier during midterms and finals.
Instead of planning a day ahead, the students should get set up about a week in advanced.
In helping international students, Castner-Post said they have special need because they?re also learning the language.
The Writing Center?s focus is to help the international students, not only with the same kind of issues that help our native English speakers have, but the center also helps them with sayings that English-speakers use that do not translate very easily in other languages.

(AP) ? French President Nicolas Sarkozy urged the Palestinians on Tuesday to drop their bid for U.N. membership and opt instead for upgraded status in the world body, but Palestinian President Mahmoud Abbas remained determined to pursue international recognition of an independent state.

Diplomats close to the talks said Sarkozy would outline on Wednesday his proposal for the Palestinians to seek approval in the General Assembly, where no member holds a veto, for a resolution that would make Palestine a non-member observer state, raising their status from that of permanent observer.

Such a move would avoid a certain U.S. veto if the Palestinian membership bid were put to a vote in the Security Council. The diplomats spoke on condition of anonymity to discuss private talks.

With Abbas determined to seek membership rather than upgraded status, the Palestinian delegation relentlessly knocked on diplomatic doors at the U.N. trying to sell their case for international recognition. Israel's prime minister, meanwhile, issued dire warnings against hasty action as he boarded his jet for New York.

The issue of the unilateral Palestinian declaration of statehood, born of decades of frustration and failed negotiations with Israel, has consumed diplomats who are gathering for Wednesday's opening of the annual U.N. General Assembly ministerial meeting.

Abbas has rejected all attempts to steer him away from formally submitting an application for full U.N. membership. He plans to submit the application on Friday when he speaks to assembled world leaders.

For his part, Israeli Prime Minister Benjamin Netanyahu, in a meeting with members of his hardline Likud Party before leaving Jerusalem late Tuesday, vowed to speak "the truth" in New York ? "the truth of a people that wants peace, a nation that was attacked time after time and that is being attacked time after time by those that don't oppose our policies but rather our very existence."

He said he would warn world leaders against prematurely establishing a Palestinian state when many issues in the conflict must still be resolved. He did not elaborate, saying this would be the focus of his speech to the U.N. on Friday, scheduled shortly after Abbas'.

The White House said late Tuesday that President Barack Obama would meet with Abbas on the sidelines of the U.N. gathering on Wednesday. Obama's diplomatic team has repeatedly said the United States, Israel's closest ally, would exercise its Security Council veto should the Palestinians win the necessary nine of 15 votes in the powerful body to adopt a resolution recommending U.N. membership for Palestine.

Officials close to the U.S. and European delegations indicated Obama would be making a last effort to steer Abbas away from a move in the Security Council that would force Washington to act on its promise to block the move. American diplomats have worked at a furious pace to lure the Palestinians back to negotiations, knowing a U.S. veto was certain to inflame anti-American sentiment in the Arab world.

While the U.S has said it will vote no, the other 14 members of the U.N. Security Council have not publicly declared their positions. China, Russia, India, Lebanon, South Africa and Brazil were all expected to vote yes. Germany was expected to vote no with the United States or abstain. Still unknown were the positions of France, Britain, Bosnia, Colombia, Gabon, Nigeria, Portugal with many saying they needed to see the text of a draft resolution before making a decision.

U.S. and other diplomats say the European Union, supported by the U.S., now was trying to work out wording of an agreement that could avert the U.N. showdown over Palestine. There was no sign, however, that either Israel or the Palestinians will agree.

Officials say Israel is being asked to accept its pre-1967 War borders with land swaps as the basis for a two-state solution. The Palestinians would essentially have to recognize Israel's Jewish character.

Those issues remain sticking points. Officials say there is also disagreement among the mediators as Russia is finds some elements unacceptable.

The officials spoke on condition of anonymity because of the sensitivity of the diplomatic negotiations.

The seemingly endless road toward peace in the Middle East, a caustic and seemingly insoluble problem, has found its way into the fiery partisanship of American politics as the races heats up for next year's presidential vote. Texas Gov. Rick Perry, the front-runner for the Republican nomination to challenge Obama, lambasted the president in a speech Friday during a campaign stop in New York.

"We would not be here today at this very precipice of such a dangerous move if the Obama policy in the Middle East wasn't naive and arrogant, misguided and dangerous," Perry said, referring to Obama's insistence early in his presidency that Israel stop constructing Jewish settlements in the West Bank and east Jerusalem, territory that would form the core of an independent Palestine.

The political give-and-take was equally fierce among diplomats clustering at the U.N.

Among his many stops on Tuesday, Abbas met with Sarkozy and British Foreign Secretary William Hague.

Were the Palestinians to take Sarkozy's advice, they would become a non-member observer state, status like that of the Holy See. That would give them an opportunity to seek membership in U.N. agencies and join treaties, including the Rome statute that established the International Criminal Court.

But Mohammed Ishtayeh, an Abbas aide, said Lebanon's President Michel Suleiman, whose country holds the Security Council presidency this month, urged the Palestinian leader to proceed with the application for U.N. membership.

Ishtayeh said discussions with Sarkozy and Hague "focused on what can be done to avoid going to the Security Council," adding that "some still believe that a way out can be found." But he said Abbas made it clear that the discussions should be focused on the aftermath of the Palestinian application to the Security Council.

France is home to an estimated 5 to 6 million Muslims, the largest such population in Western Europe. Their family backgrounds mostly are traced to former French colonies in North Africa.

French Foreign Minister Alain Juppe, who also was in New York, told Europe-1 radio in Paris that his country still was working to get Mideast peace talks restarted before the United Nations faces a vote. "The status quo is untenable," Juppe said. "The only way to settle the Israeli-Palestinian problem is direct negotiations."

Abbas also met with Arab League Secretary General Nabil Elaraby and Suleiman.

"I believe that first of all the Palestinians are entitled to be considered as a state," Elaraby said. "They enjoy the same basis as Israel . . . and they're entitled to declare the state and they have declared it and the international community has to react to that positively."

Saeb Erekat, the chief Palestinian negotiator, sat down with former British Prime Minister Tony Blair and U.S. Mideast envoy David Hale. Blair serves as the point man for the so called Quartet ? the U.S., the U.N., the European Union and Russia ? that has tried to shepherd the Israelis and Palestinian back to peace talks.

"We know that they (the U.S.) will use the veto against our demand in the Security Council. They've told us that many times," Erekat said.

Closing California's achievement gap - CFED News Clips

Test scores indicate that although the state has far to go in improving results for disadvantaged and minority students, schools have made truly laudable gains with younger students, regardless of ethnic or economic category.

Most of the upheaval in public education over the last decade was prompted by the achievement gap. Middle-class, white and Asian American students scored much higher on standardized tests than their disadvantaged, black and Latino counterparts. Those in the latter groups were far more likely to drop out and far less likely to attend college. The gap doomed entire subpopulations to generally lower-paid, less-fulfilling jobs as well as higher unemployment.

The reasons for the gap are many and complex. But there's no denying that at least part of it has been caused by shameful disparities in the allocation of school resources. Just a few years ago in the Los Angeles Unified School District, students in poorer neighborhoods couldn't take the courses required to attend a four-year college -- no matter how bright or hardworking they were -- because their high schools didn't offer the courses. When there was a shortage of qualified math and science teachers, these schools, not the ones in more affluent areas, were assigned teachers who lacked credentials in the necessary subjects.

The federal No Child Left Behind Act was a clumsy attempt to address such lapses by demanding steep improvements in the standardized test scores of the low-achieving groups so that by 2014 they would have the same levels of proficiency as more privileged students. In fact, under the law, every student would be proficient in reading and math, an unachievable goal for any group unless the proficiency standards are set extremely low. Yet as badly as the law was written, it put needed pressure on schools to improve. And many of them did.

When standardized test scores are released each year, as California's were this summer, there are complaints that, even with strong gains overall, the achievement gap is not closing. But that's because critics of the schools tend to use an overly simple measure of relative improvement. In many ways, the state has made substantial headway, for which schools should be receiving credit.

The reading scores of white and black fourth-graders offer a good example. In 2003, when No Child Left Behind took effect, only 27% of black students in California scored as proficient, compared with 59% of white students. By this year, the proficiency rate of black students had nearly doubled, to 52%. The proficiency rate of white students had increased by about a third, to 80%. In other words, both groups improved markedly. Eight years ago, there was a 32-point gap between the two groups' proficiency rates; that has narrowed to a 28-point gap, which has been described as a "modest" reduction.

But viewed as a percentage, black students' gains were impressive. In 2003, they were less than half as likely as white students to achieve proficiency; now they are two-thirds as likely.

Attempts to measure the achievement gap lead to the uncomfortable but necessary judging of one group's growth against another's. What if, in the example above, the number of proficient white students had increased to 70% instead of 80%? The achievement gap would have narrowed substantially, but that doesn't mean black students would be any better off. As it happens, white students are often in a position to show the quickest improvement when schools do better, because they tend to have more support at home in the form of educated parents with the financial resources to provide them with enrichment opportunities. The important thing is to keep pushing for improvement for the students who have historically underachieved so that, eight years from now, we will see the achievement gap virtually erased.

There are pitfalls to any overly simple way of measuring progress, including when we judge by percentage gains. If only 2% of black students had tested as proficient in 2003 and the number were 6% now, their proficiency rates would have tripled, but there would be no cause for celebration.

What nine years of testing data for California show is that there is plenty of improvement to admire in elementary schools. Latino and low-income students, even more than African American students, raised their proficiency rates and narrowed the point gap with white students as well. Scores in elementary math improved more than those in reading. And the percentage of black and Latino students taking algebra in the eighth grade more than doubled, to virtually the same level -- about 60% -- as white students. In 2003, early critics of the No Child Left Behind Act said this kind of progress would be impossible because of poverty and low parent involvement. They were wrong.

Results are quite different for high schools, though, where none of the groups show really heartening improvement. Is that solely because high school students are more cynical about the tests and don't bother trying very hard? Probably not. Schools have only begun the process of assigning more qualified teachers to schools in low-income areas and offering college-prep courses.

Critics of the school accountability movement argue that test scores don't reflect what students have been learning. It's true that reform overemphasizes standardized tests and the arbitrary goal of scoring as "proficient," which means different things in different states. But the tests do provide a rough measure of educational basics. Students whose scores are at the bottom levels probably don't understand the material. A student who scores as proficient most likely does. The tests might measure a limited set of skills, but if students are better able to read and do math, that's an important change from where they were eight years ago.

The proper response to the tests, then, is not to bash schools for failing to eliminate the achievement gap within eight years, but to praise the progress made in lower grades without getting complacent. The state must continue to build achievement levels, especially among disadvantaged and minority students, and figure out the reasons so many high school students falter, regardless of their ethnicity or financial status. California's students are getting a stronger start, but stumbling at the finish line.
